By accessing or using Cactly, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use our Service. By agreeing to these Terms, you represent that you meet this age requirement.
2. Use of the Service
Cactly provides a curated directory of publicly available music industry contacts for professional use only. You agree to use the Service ethically, responsibly, and in compliance with all applicable laws.
You may not misuse the contact information or use it for spam, harassment, or any unlawful activity.
3. Membership and Access
Access to Cactly requires an active membership subscription.
You may start with a 2-day free trial to explore the Service before your membership begins.
You will receive an email reminder at least 24 hours before your trial ends to notify you about the upcoming charge.
4. Billing and Subscription Terms
After the 2-day free trial, your membership will automatically renew every 12 months at $1,200 unless canceled before the renewal date.
Payment is processed securely via the payment method you select during sign-up. Accepted payment methods include major credit cards and PayPal.
You are responsible for keeping your billing information up to date to avoid interruption of service.
By signing up, you explicitly consent to automatic renewal and billing at the stated rate.
5. Cancellation and Refund Policy
You may cancel your membership at any time before the end of your 2-day free trial to avoid charges.
You may also cancel your membership at any time after payment; however, membership fees are non-refundable.
No refunds or credits will be issued for partially used billing periods.
Upon cancellation, you will retain access until the end of your current paid period.
6. Intellectual Property
All content, including the directory data, design, and software, is the intellectual property of Cactly and its licensors.
You agree not to copy, distribute, or sell any part of the Service without explicit written permission.
7. Privacy and Data Use
We collect and use data as described in our Privacy Policy.
All contacts listed are sourced from publicly available information and curated ethically.
8. Email Communications and User Consent
By using Cactly, you agree to receive important service-related emails, including your free trial reminder and billing notifications.
You may opt out of marketing emails at any time via the unsubscribe link in those emails.
9. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind.
We do not guarantee accuracy or completeness of contact information.
10. Limitation of Liability
Cactly is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Service.
11. Changes to Terms
We may update these Terms at any time. Continued use of the Service after changes indicates your acceptance.
